Terms of the agreement

The terms of this agreement will begin upon our acceptance of your Free Fivers affiliate program application. Either the affiliate or Existem Ltd may terminate this agreement at any time with immediate effect*, with our without cause by giving the other party written notice of such termination.

*If we terminate your agreement with cause, i.e. you have generated fraudulent signups to Free Fivers, generated fraudulent revenue or have spammed your affiliate links you will forfeit all commission owed to you.

If you decide to terminate this agreement you will still be paid all commissions owed to you as long as they are above the minimum payment level of £25 at the time of termination.

If we terminate your account without cause, you will still earn lifetime revenues for your referred users for as long as they remain an active user of Free Fivers; an active user is defined as a member who has logged into their account once over the previous 12 months.

Tracking

We have developed our own in-house tracking software which tracks registration via cookies – set for 999 days.

After registration each member ID is permanently tagged to your affiliate account for life. It cannot be overwritten or removed.

Reporting

All usual reporting tools that can be found on traditional affiliate networks can be discovered after you log into your affiliate control panel. Statistics are updated real-time, your username and password will be given to you after registration.

• Members referred
• Transactions per member
• Total transaction value between dates
• Historical statistics
• EPI data (unique tracking ID's) & reports
• Payment statistics

Commission & Payments

Affiliates will earn a revenue share on all income generating clicks and transactions from users that they refer to the service.

Revenue share varies depending on your performance the entry level being 35% of gross profit.

Partner revenue share is paid on the 10 th of each month, that's 40 days after the end of the month. This allows us to track returns and reversals from our merchants.

i.e payment for any commissions made in January will be paid on the 10 th March.

Payment will be made by cheque to the name detailed on your ‘profile' our minimum payment threshold has been set at £25

VAT 17.5% will be added subject to receiving a valid VAT and company number.

Modification

Existem Ltd may modify this agreement at any time at our sole discretion. If we choose to do so you will be notified by posting this change in your affiliate control panel.

Your continued use of the Free Fivers Affiliate Program following such notice will constitute binding acceptance of the change.

Limitation of Liability

Existem Ltd shall not be liable to the affiliate for defects in the service, interruptions in the accessibility to the service, infringements on data or loss of data within the Free Fivers database, defects in the security system, viruses or other harmful software components, loss of profits, contracts, loss of reputation, or other indirect or consequential loss whether arising from negligence, breach of contract or whatsoever.

Our aggregate liability arising with respect to this agreement and the affiliate program will not exceed more than twice the total commission paid to you under this agreement.

Existem Ltd cannot guarantee or warrant the performance of Free Fivers or the links to any linked websites. Existem Ltd shall not be liable for any error in the implementation of the links on the affiliate's website or for the specified function of the links.

Copyright / Intellectual Property.

Existem Ltd owns all copyrights, trademarks, intellectual property rights, know-how or any other rights connected to the service or software necessary for the service. The Affiliate does not acquire any rights or licenses whatsoever under this Agreement other than to use links to linked websites on the terms of this agreement.

Applicable Law

This agreement is subject to the laws of the United Kingdom and shall be subject to the non-exclusive jurisdiction of their courts.
